4. When and With Whom We Disclose Information

We may make personal information available to the following recipient categories when reasonably necessary for the stated business or legal purpose.

Ecommerce, Hosting and Technology Vendors

Our online store operates on Shopify. These vendors host and operate the store, provide website functions, process site activity, and support performance and security.

Payment and Financial-Service Providers

They support authorizations, payment processing, refunds, fraud screening, disputes and chargebacks.

Shipping, Fulfillment and Delivery Providers

To fulfill an order, these providers may receive recipient names, addresses, email addresses, telephone numbers, order details and delivery instructions. This category includes parcel carriers, fulfillment partners and freight or LTL providers for Bulk Orders.

Customer-Service and Communications Vendors

These vendors support email, text messaging, contact forms, newsletters and customer care.

Analytics and Advertising Providers

We use services from Google (including Google Analytics and Google Ads) and Meta (including Facebook and Instagram) to measure usage and performance, attribute transactions, build or evaluate audiences, and display or personalize advertising.

Security and Fraud-Prevention Providers

These services assist with authentication, abuse and fraud detection, cybersecurity and legal compliance.

Professional Advisers

We may provide relevant information to lawyers, accountants, auditors, insurers, consultants and other advisers when reasonably required.

Government, Regulatory and Legal Recipients

Information may be disclosed to comply with law, legal process or governmental requests; meet product-safety or regulatory duties; enforce agreements; establish or defend claims; or protect the rights, property, health or safety of Franceschi Chocolate, customers, workers or others.

Business Transactions

Information may be transferred or reviewed in connection with a contemplated or completed acquisition, financing, merger, reorganization, bankruptcy, asset sale or comparable transaction.

Disclosures You Request or Authorize

We may disclose information when you instruct us to do so or otherwise provide permission.

Where Information Is Processed

We are based in the United States, and personal information is generally stored and processed in the United States. Some of our team members and service providers, including our ecommerce platform, may access or process information from other countries. When this happens, we take reasonable steps so that the information remains protected as described in this Policy.

5. Cookies, Analytics and Advertising Technologies

We and our providers may employ cookies, pixels, tags, local storage, application programming interfaces, server-side events and related technologies.

Technologies required for core operations may support:

  • Shopping carts and checkout
  • Account sign-in
  • Payment and transaction security
  • Fraud prevention and site security
  • Saved preferences and other essential site functions

Other technologies may be used to measure traffic, performance and interactions; understand product and page views; diagnose errors; attribute purchases; evaluate campaigns; limit repeated advertisements; create or measure audiences; and personalize advertising.

Subject to browser, device, consent-manager and other applicable controls, analytics and advertising services such as Google and Meta may receive online identifiers, IP addresses, pages or products viewed, cart activity, advertising interactions, conversion events, referral or campaign data, approximate location and inferred interests. Those providers may analyze activity across time, websites and online services under their own privacy practices.

Meaning of “Sale,” “Sharing” and Targeted Advertising

Franceschi Chocolate does not sell customer lists or personal information for cash. Certain state laws use broader definitions under which transferring online identifiers or site activity to advertising providers can qualify as a “sale,” “sharing” or targeted advertising even without a monetary payment.

We do not knowingly sell or share personal information belonging to consumers under 16 years old.

Where applicable law gives you the right to opt out of targeted advertising, you can do so through the cookie and privacy preferences link in the footer of our website or by contacting us as described in Section 8.

Your Cookie and Tracking Options

Depending on the technology and applicable law, you may limit tracking through browser or device controls, deletion of stored cookies, privacy or content-blocking extensions, provider advertising settings, or available analytics opt-out tools. Choices are commonly browser- and device-specific and may need to be repeated after clearing storage or using a different browser or device.

Disabling all cookies can impair the cart, checkout and other site functions. Browser cookie controls may not affect some server-side security or transaction events.

Do Not Track and Browser Privacy Signals

Where required by applicable law, our website treats a Global Privacy Control (GPC) signal sent by your browser as a request to opt out of targeted advertising for that browser. We do not otherwise respond to Do Not Track signals. You may also contact us about available privacy choices.

6. Email, Text Message and Marketing Preferences

You may stop promotional emails by using the unsubscribe link in the message or contacting us at info@franceschichocolate.com. We may keep a limited suppression record to ensure the request continues to be honored.

If you opt in to receive marketing text messages, you agree to receive recurring automated messages at the number you provide. Consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to cancel at any time or HELP for help.

We do not share mobile phone numbers or text-message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. We share this information only with the service providers that send our text messages on our behalf.

Opting out of promotions does not prevent transactional or service communications involving:

  • Orders and shipping
  • Claims, replacements and refunds
  • Account or payment security
  • Product recalls or safety matters
  • Customer-service requests
  • Other transactions or services you requested

7. Retention of Personal Information

We keep personal information for no longer than reasonably necessary for the purposes described here. Relevant considerations may include:

  • The duration of the customer, account or business relationship
  • Order fulfillment and support needs
  • Claim, refund, dispute and chargeback windows
  • Tax, financial and accounting rules
  • Food-safety and lot-traceability requirements
  • Fraud-prevention and security needs
  • Contractual duties and limitation periods
  • Existing or reasonably anticipated claims, investigations or litigation
  • Preservation obligations and legal holds
  • Marketing preferences and suppression records
  • The configured lifespan of the relevant system or technology

Transaction records may remain after account closure when required for accounting, taxation, traceability, dispute resolution or compliance. When information is no longer needed, we may delete, aggregate, deidentify or securely dispose of it.

8. Access, Correction and Other Privacy Requests

Account holders may be able to review or revise certain information after signing in. You may also contact us to request access to or correction of information associated with you.

If the law applicable to you and to Franceschi Chocolate provides these rights, you may be entitled to:

  • Access personal information
  • Correct inaccurate information
  • Delete qualifying information
  • Receive a portable copy of certain data
  • Opt out of qualifying sale, sharing or targeted advertising
  • Appeal a decision on a privacy request
  • Exercise privacy rights without unlawful discrimination or retaliation

Legal definitions, exceptions, verification rules and limitations apply. This Policy does not grant rights beyond those established by applicable law.

We may decline or limit a request when identity or authority cannot reasonably be verified or when the law permits or requires retention, including to complete transactions, provide requested products, maintain safety or traceability records, prevent fraud, satisfy legal or accounting obligations, enforce agreements, or handle legal claims.

An authorized agent may act where permitted by law, subject to reasonable proof of authority. We will respond within the timeframe and through the process required by applicable law.
